1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Brian Werle/ID-Firewall ("Company," "we," "us") governing your use of the Family Safe-Word & Voice Verification Manager mobile application (the "App").

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE APP.

2. Description of App

The App is a personal security tool designed to help families establish and manage shared safe-words and structured verification protocols to reduce the risk of being deceived by voice cloning or impersonation scams. The App provides:

• A secure vault for storing rotating family safe-words
• Structured verification scripts and questions
• Optional SMS alert notifications to family members
• Educational guidance about voice cloning scam risks

3. CRITICAL DISCLAIMER — NO GUARANTEE OF PROTECTION

THE APP IS A SUPPLEMENTAL AWARENESS AND COORDINATION TOOL ONLY. IT DOES NOT GUARANTEE PROTECTION FROM FRAUD, SCAMS, VOICE CLONING, OR ANY OTHER CRIMINAL ACTIVITY. THE EFFECTIVENESS OF THE APP DEPENDS ENTIRELY ON HOW IT IS USED BY YOU AND YOUR FAMILY MEMBERS. THE COMPANY MAKES NO WARRANTY, EXPRESS OR IMPLIED, THAT USE OF THE APP WILL PREVENT ANY FINANCIAL LOSS, EMOTIONAL HARM, IDENTITY THEFT, OR OTHER INJURY.

4. LIMITATION OF LIABILITY

4.1 No Liability for App Failure

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

• Any failure, malfunction, error, delay, interruption, or unavailability of the App or any of its components for any reason whatsoever
• Failure of safe-word, verification question, or notification features to function as intended
• Any SMS notification that is not delivered, is delayed, is misdirected, or fails for any technical reason
• Any unauthorized access to your account or App data
• Any action or inaction by you or any third party in reliance on the App
• Any fraud, scam, financial loss, emotional distress, or other harm suffered by you or any third party even while using the App
• Any data loss, corruption, or breach involving information stored in the App
• Any error or inaccuracy in safe-words, questions, answers, or notifications stored or transmitted by the App

4.2 No Liability for User Error

The Company is not liable for any harm resulting from your failure to use the App correctly, your failure to update or rotate safe-words, your disclosure of safe-words to unauthorized parties, or your reliance on the App without maintaining other independent verification methods.

4.3 Third-Party Services

The App may rely on third-party services including SMS carriers, cloud providers, and mobile operating systems. The Company is not liable for failures, outages, or errors caused by third-party services.

4.4 Cap on Liability

IN NO EVENT SHALL THE COMPANY'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIVE DOLLARS ($5.00 USD).

5. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION: (A) ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT; (B) THAT THE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (C) THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; AND (D) THAT THE APP WILL PROTECT YOU OR YOUR FAMILY FROM ANY SCAM, FRAUD, OR CRIMINAL ACT.

6. User Responsibilities

You agree that you are solely responsible for:

• Maintaining the confidentiality and security of your App account, login credentials, and safe-word content
• Ensuring all family members understand and actively participate in the verification protocols
• Regularly updating and rotating safe-words and security questions
• Using the App as a supplemental tool alongside other fraud prevention practices
• Ensuring you have obtained the consent of any person whose phone number you enter into the App
• Compliance with all applicable local, state, and federal laws in your use of the App

7. Prohibited Uses

You agree not to use the App to:

• Harass, stalk, or harm any person
• Send unsolicited or unauthorized SMS messages
• Impersonate any person or entity
• Circumvent, disable, or interfere with security features of the App
• Use the App for any unlawful purpose
• Reverse-engineer, decompile, or disassemble the App

8. Indemnification

You agree to indemnify, defend, and hold harmless Brian Werle/ID-Firewall and its officers, employees, agents, and successors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) any claim by a third party arising from your use of the App.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the state in which the Company is registered, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the App shall be resolved through binding individual arbitration under the rules of the American Arbitration Association, and not through class action. You waive any right to a jury trial or to participate in a class action lawsuit.

10. Modifications to Terms

We reserve the right to update these Terms at any time. We will provide notice of material changes through the App. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, for any reason, with or without notice. Upon termination, your right to use the App ceases immediately.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company with respect to the App and supersede all prior agreements, understandings, or representations.
